At KCI Technologies, Inc. (“KCI”), we take the issue of your privacy seriously and are committed to the careful handling of information relating to you in identified or identifiable form (“Personal Data”). This Privacy Policy is intended to describe how KCI (“we,” “us,” or “our”) might collect, use, disclose, and otherwise manage personal information (“Personal Data”) from users of the BRYX website and BRYX models (collectively, “Services”).

By using our Services, you agree to the collection and use of Personal Data in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Services.

Applicability

This Privacy Policy applies to our Services only. This Privacy Policy does not apply to any third-party application or software that integrates with our Services, or any other third-party products, services or businesses who will provide their services under their own terms of service and privacy policy.

Types of Personal Data Collected

Personal Data can, alone or associated with other information, be used to identify an individual, for instance by reference of a name, a username, an email address, and Internet Protocol (“IP”) address, or others. The types of Personal Data collected by KCI through our Services include:

  • Information you provide directly. We collect information that is directly provided while using our Services, such as:
    • Information provided as part of setting up an account, including first and last name, email address, organization, country, state, and zip code.
    • Data, images, text, information, or files (“User Datasets”) that are uploaded for use with our Services.
  • Information we collect from third parties. We may collect information from third parties, for example if you choose to access our Services through a third-party integrated service like Google.
  • Information we automatically collect from usage. We may collect information such as your device’s IP address, browser type, browser version, pages visited, User Datasets that have been accessed, User Dataset name and description, single sign-on authentication requests, retraining preferences, data upload timestamp, the time/date of your visit, unique device identifiers, and other diagnostic data (“Usage Data”).

    We also collect Personal Data via Google Analytics and cookies to understand how visitors engage with our Services. You can opt out from the use of Google Analytics by downloading and installing the Google Analytics Opt-out Browser Add On, provided by Google.

Use of Personal Data

We collect your Personal Data to analyze and use it in the provision, use, and performance of various aspects of our Services, including to:

  • Deliver our Services, including facilitating account creation and authentication.
  • Train, improve, and enhance our Services, including other development, diagnostic or corrective purposes in connection with our Services.
  • Send you notifications regarding our Services, notifying you of new products, updates, resources, or for service-related matters, if you choose to opt-in.
  • Facilitate quality control measures based solely on incident-based crash reports.
  • Perform functions as otherwise described at the time of collection.
  • Comply with any legal requirements or obligations.
Security Safeguards

We use generally accepted technical and organizational measures to protect the Personal Data that we collect and process against accidental or intentional manipulation, loss, destruction, or other unauthorized access or disclosure. However, no method of transmission of information over wireless and wired networks is inherently secure, and we do not warrant the security of User Datasets or Personal Data or that private communications will always remain private when using our Services.

We also have procedures in place to manage any suspected data security breach. We will notify you and any applicable regulator of a data security breach where we are legally required to do so.

Retention of Your Personal Data

Except for User Datasets and Usage Data, we will retain Personal Data while you have an account with us or while we are providing Services to you in order to comply with applicable laws, keep accurate records, resolve disputes, prevent fraud, or for any other legally permissible purpose.

We will retain User Datasets indefinitely in order to enhance our Services, unless you have expressed a preference to withhold your data from training, or for any other legally permissible purpose. We will also retain Usage Data for internal analysis purposes. Usage Data is typically retained for a shorter period of time except when this data is used to strengthen the security or improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Personal Data that you provide to us or that we collect as a result of your use of our Services will be stored and processed in the United States. For customers located in the United States, your data may be transferred outside your state where the data protection laws may differ than those from your jurisdiction.

For customers residing outside of the United States, your data will be transferred outside your country or other governmental jurisdiction where the data protection laws may differ than those of your country or jurisdiction.

By using our Services, you consent to this transfer of such information. We will take steps reasonably necessary to treat your Personal Data securely in accordance with this Privacy Policy. No transfer of your Personal Data will take place unless there are industry standard security controls .

In the event that we sell or transfer ownership of our Services, you own all right, title, and interest in your Personal Data. However, we may sell or transfer any proprietary information or analytic insights derived therefrom.

Disclosure of Personal Information

We may disclose Personal Data as part of a proposed or actual merger, acquisition, or asset sale subject to a confidentiality agreement. We will provide you notice before your Personal Data is transferred and becomes subject to a different privacy policy.

Age Limitations

Our Services are not directed at individuals under the age of 16 or such other age designated by applicable law (“minors”). We do not knowingly collect or ask for Personal Data from minors. If you learn that a minor has provided us with Personal Data, please contact us and we will take steps to delete that information.

Access to Personal Information

You have the right to access, review, update, and delete your Personal Data in our custody and control, subject to certain exceptions for User Datasets or as prescribed by law. You may contact us to make a request about your Personal Data using the contact information set out below. Any disclosure of Personal Data in response to such a request will be done only after confirming the identity of the requesting party.

Changes to the Privacy Policy

The policies outlined above may be subject to change in the future without prior notice to reflect changes in our Personal Data practices. Any revised Privacy Policy will be posted on gobryx.com. To the extent that the Privacy Policy changes in a material way, we will generally treat your Personal Data in accordance with the policy (or the applicable terms of a license or legal agreement with you) in place at the time your Personal Data was collected, or as you otherwise consent. The Privacy Policy includes a “last updated” date, which refers to the date that the current version was last substantively modified.
